If you are run off the road or injured by a “phantom vehicle” (a vehicle whose driver fails to make contact with you and leaves the scene), you are required by Wisconsin state law to do the following in order to be covered by insurance:
- Find a witness who can corroborate what happened and who does not have a claim as a result of the accident
- File an accident report with law enforcement within 72 hours of the incident
- File a report with your insurance company under oath within 30 days of the incident
If you fail to do any of the above, your insurance coverage can be denied.
